General terms and conditions
ARTICLE 1. scope and definitions of the general terms and conditions
1.1 – These general terms and conditions (hereafter referred to as “T&C”) apply to the website of the online PETER POLO store (hereafter referred to as the “Website”) as well as to any orders placed on the Website.
1.2 – Please read these T&C carefully before placing your order on the Website. Access to certain parts of the Website as well as orders placed on the Website are subject to the application of these T&C. We advise you to make a copy of these T&C so that you can refer to them at a later date. Click [here] to print out or download a copy.
1.3 – These T&C are applicable to Mainland France and are available solely in their French version.
ARTICLE 2. the contract of sale
2.1 – Your order constitutes acceptance of our offer and specifically acceptance of the proposed price and designated products. Consequently, when you confirm your order, you agree to be bound by the contract of sale.
We undertake to fulfil the orders we receive subject to availability of stock. If the product that you have ordered is no longer available we will inform you and cancel your order for the product which is no longer available. In the event that some of the products you have ordered are no longer available, we will process your order for the products that are available and inform you of the unavailability of the other products in the “Delivery Email”. The order pertaining to the products that are no longer available will, if need be, be cancelled.
Acceptance of the order is conditional upon the validation of your payment.
In the event that your payment is not validated by your card issuer, or in the event of fraud or the reasonable suspicion of fraud taking place, your order will not be accepted and will automatically be cancelled.
2.2 – If you fail to respect the terms and conditions set out in these T&C, and in particular the conditions set out in article 8 (3) which stipulates that goods must be returned in their original condition, or if you fail to pay PETER POLO for one or more of your orders placed with us, PETER POLO reserves the right to refuse your future orders.
ARTICLE 3. THE ORDER
3.1 – To select items from our range of products, click on “Add to basket” in order to add them to the “Basket & Payment” category. When you have selected your basket of purchases, confirm by clicking on “Proceed to payment”, where you will be able to purchase all the items in your basket. By accepting our offer, the contract of sale is concluded and you are then bound by this contract.
3.2 – Before placing an order, you can check and modify the details of your orders at any time by clicking on “Basket & Payment”.
3.3 – When you have placed an order, you will automatically receive a confirmation email (“Confirmation email”) summarising the details of your order. We advise you to print out and keep this email. This email confirms that we have received your order.
3.4 – We remind you that these T&C apply to Mainland France and the European Union and that PETER POLO will not accept orders with delivery addresses outside of French territory. Similarly, these T&C do not apply to French overseas territories and departments.
3.5 – When your items are dispatched you will be sent a second email (“Delivery email”) indicating the date on which your chosen items will be delivered.
ARTICLE 4. CREATING A PERSONAL ACCOUNT
4.1 – In order to simplify ordering on our Website, you have the possibility of creating a personal account. If you choose to take advantage of this opportunity, all the personal data that you provide at the time of creating your account will be stored in our database and you will not have to provide it when placing new orders. Your data will automatically be captured from the order form.
4.2 – In order to register with us, you must send the following information via the online registration form: surname, forename, address, date of birth, email address and delivery address if this is different. This information will be recorded in our database in accordance with the conditions relating to the protection of data that may be modified[ICI].
4.3 – When you have created your personal account, an email will automatically be sent to you confirming that your account has been created. Your email address will be your account user name. When you register for your personal account, you will be asked to create a password. You will have the opportunity to change it when you log into your account. You should always keep your user name and password secret and do not reveal them to any unauthorised third party. You will be solely responsible in the event of your user name and password being used fraudulently.
ARTICLE 5. DELIVERY deadline
5.1 – The Delivery email will indicate the probable delivery date of the items you have ordered. This delivery date will normally be from two to four working days from the date on which the Delivery email was dispatched. The products you have ordered will be delivered to you within the period indicated in the Delivery email.
5.2 – Although we will do everything in our power to deliver your order on the date indicated in the Delivery email, the delivery may take longer than anticipated. In the event that we are unable to respect the delivery date indicated in the Delivery email, we will advise you as soon as possible and provide you with a new delivery date. If the anticipated delay is greater than ten days, however, you have the option of cancelling your order within a period not exceeding 30 working days. Should you receive the items you have ordered after submitting a request for cancellation, we will proceed with a full refund as soon as the items have been returned to us in their original condition.
5.3 – If you have placed several orders, it may be necessary for us to make several different deliveries. If this is the case, we will inform you in advance.
5.4 – As soon as the ordered items are delivered to you, they are deemed to be under your responsibility.
ARTICLE 6. DELIVERY PRICE AND CHARGES
6.1 – The prices indicated on the Website include all taxes. PETER POLO reserves the right to modify its prices at any time, but products will be invoiced based on the prices in force at the time the orders were placed.
6.2 – The prices indicated on the Website do not include delivery charges. Delivery is offered free on all orders over 60€. If you decide to cancel your order and return the items you have ordered, the cost of returning the items is your responsibility.
ARTICLE 7. PAYMENT AND DEFAULT OF PAYMENT
7.1 – The payment for items ordered must be made by credit card as indicated at the time of payment. We accept the following bank cards: Visa / CB / Eurocard and MasterCard. All transactions are strictly confidential and are protected by SSL encryption.
In accordance with our commitment regarding payment security, we check the reliability of information recorded at the time of placing your order. This process is part of our drive to combat the phenomenon of fraudulent payments being made over the internet, thus protecting all consumers.
7.2 – The entire price of your order will be debited from your card when your order is confirmed, and prior to dispatch of your order.
You certify that you are the holder of the credit card used for payment. Checks and authorisations will be carried out by the card issuer. If the card issuer refuses to authorise payment, your order will not be accepted and we cannot, under any circumstances, be held responsible for the delay or absence of delivery. Furthermore, we are under no obligation to inform you of the reason for the refusal.
ARTICLE 8. RETURN WITHIN 14 DAYS
8.1 – If you are unhappy with the goods you have ordered, for whatever reason, you have the right to return them in exchange for a full refund. Return postage is at the customer’s expense.
8.2 – This right may be exercised within a period of 14 days following receipt of the items ordered by sending written notification.

8.3 – You can claim a full refund for the goods returned to us provided that:
a) you return the goods to us using the product return form to: PETER POLO 108/109 rue François Sibilli, Lieu dit la Garonne – Passage du port 83990 SAINT-TROPEZ within 14 days of delivery of your order;
b) the goods are returned in their original condition, and have not been damaged, washed, altered or worn and are returned with their original packaging, as well as any accessories and/or instructions supplied with the items.
8.4 – We will refund your payment in full by crediting the credit card used to pay for your order, within thirty days of receiving the returned items, in accordance with the conditions of article 8 (3) (b).
8.5 – We would request that you take good care of the items in your possession and to return them to the address indicated in article 8 (3) as soon as possible after cancellation of your order.
8.6 – Please note that if you fail to take good care of the goods or fail to return them to us, we will take legal action against you to compensate for the loss suffered. We also reserve the right to prohibit you from using our Website.
8.7 – If we have not received your items within a reasonable period following your cancellation, we reserve the right to send a courier to the delivery address in order to recover the goods. The cost of recovery will be charged to the customer.
8.8 - PETER POLO is not obliged to accept returned goods and proceed with a refund if the returned items do not satisfy the conditions set out in article 8 (3) (b). Goods that are not accepted by PETER POLO will be returned to you.
ARTICLE 9. DEFECTIVE PRODUCTS
9.1 – If the items you have ordered are defective or do not correspond to the description presented on our Website, please get in touch with us as quickly as possible at the following address: email@example.com.Please return any defective items to us with the return form, and we will replace the items if they are available or proceed with a full refund.
ARTICLE 10. YOUR PERSONAL INFORMATION
10.1 – Your personal information

10.2 - Cookies

A cookie is a mechanism that enables the user to be identified as well as recording information regarding the user’s navigation on the Website. If they wish, internet users can deactivate cookies in their web browser settings.
ARTICLE 11. RESPONSABILITY
11.1 – We cannot be held responsible for loss or damage that may be caused when this loss and damage could not reasonably be anticipated, either by you or by us, at the time of accepting these General Terms and Conditions (this includes cases in which the loss or damage results from a breach of these T&C). Loss or damage considered foreseeable is that which you or we have been able to anticipate.
11.2 – Similarly we cannot be held responsible for any loss or damage which may be caused if your online purchases are intended for resale, commercial purposes or any other purposes than those set out in article 2 (3).
11.3 – We
a) cannot be held responsible for any damage caused to your computer system or for any loss of data resulting from use of our Website;
b) cannot guarantee the content and services available on the Website. All the content and services are accessible according to availability.
c) cannot guarantee that the Website will be continuously accessible and operational, nor can we guarantee that the information available on the Website is free of errors or omissions (when such errors or omissions are brought to our attention, however, we will do everything in our power to rectify the situation as quickly as possible).
11.4 – When you place an order on our Website, our responsibility to you for any loss or damage that may be subject to the present General Terms and Conditions is limited, for each complaint, to the purchase price of your order.
11.5 – We cannot be held responsible for any delays or failures to respect the obligations set out in these T&C if these delays or failures result from events beyond our control. Such events include, but are not limited to, paralysis of the transport infrastructures, government intervention, war, civil insurrection, hostage situations, fires, floods, accidents, storms, strikes, terrorist attacks or any type of industrial event that may affect our services or those of our suppliers.
ARTICLE 12 – INTELLECTUAL PROPERTY
12.1 – The use of the Website does not confer copyright, or rights regarding designs, models or brands, or any other intellectual property (or intellectual property rights belonging to third parties).
12.2 – The Website is offered solely for your private and non-commercial use. The contents of the Website may not be used for any purposes other than those previously outlined without our express and written agreement.
ARTICLE 13 – FINAL CLAUSES
13.1 - In the event of modifications to the present General Terms and Conditions, we will inform you of the changes on our Website. A message asking you to accept the new T&C will appear when you place your order.
13.2 – The orders/sales made through our Website, as well as these T&C are subject to French law and any disputes that may arise within the framework of the aforementioned orders/sales will be subject to non-exclusive French jurisdiction.
13.3 – In the event that one of the clauses of these T&C should be judged null or illegal, the validity and legality of the other clauses will not be affected.
